Terms of Service

1. Scope

These Terms & Conditions apply to all orders placed with Apex Motion (“Apex Motion”, “we”, “us”) via our website or directly. By placing an order, the customer (“you”) accepts these terms in full.

2. Company Information

Apex Motion is operated by Collectomat GmbH, registered in Switzerland.

3. Products

Our karts are high-end, electric homage vehicles inspired by iconic sports cars. They are not street legal and are intended for private use only.

4. Orders & Contract

  • An order becomes binding once confirmed by us in writing (email order confirmation).
  • For bespoke and customized models, specifications are agreed upon before production begins.
  • All specifications confirmed at checkout or in writing are considered final.
  • Apex Motion reserves the right to decline orders at its discretion.

5. Prices & Payment

  • All prices are displayed in the customer’s local currency and include applicable VAT or sales tax based on the customer’s location, unless stated otherwise.
  • Customers may choose to pay the full amount upfront or in installments as outlined below.
  • Production begins upon receipt of the first deposit or full payment.
  • The standard installment schedule is:
    • 35 % deposit to initiate production
    • 30 % after production completion
    • 35 % before shipment
  • All payments are non-refundable once production has begun, as each kart—whether part of the Signature Collection or a Bespoke configuration—is built individually to order.
  • Apex Motion retains full ownership of the product until all payments have been received in full.
  • Apex Motion reserves the right to withhold or cancel delivery if an order is unpaid or not fully paid.
  • In the event of late payment, Apex Motion may charge a reminder fee of CHF 50.00 per notice and reserves the right to claim additional collection or legal costs if necessary.

6. Delivery

  • Estimated delivery times are provided after order confirmation.
  • We are not liable for delays caused by logistics providers or circumstances beyond our control.
  • Delivery is made to the address specified by the customer.
  • Delivery within continental Europe (EU & EFTA) is included in the price. Shipments outside this zone or to remote or island destinations (e.g., Iceland, Canary Islands, Madeira, Cyprus) may incur additional freight costs.
  • Risk and ownership transfer:

    Ownership transfers to the customer only after full payment has been received. Once ownership has transferred or the goods have been handed over to the carrier for shipment, the risk of loss or damage passes to the customer in accordance with Article 185 of the Swiss Code of Obligations (OR). Apex Motion is not liable for any loss, damage, or destruction occurring after this point.

7. Returns & Cancellations

  • All sales are final.
  • Due to the bespoke and highly customized nature of our products, no cancellations, returns, or refunds are possible once production has started.
  • If a client fails to complete payment as scheduled, Apex Motion may retain all payments received to date as compensation for production and administrative costs.

8. Warranty

  • Our karts are covered by a 2-year warranty against manufacturing defects, in line with statutory requirements.
  • Warranty does not cover normal wear and tear, misuse, modifications, or improper storage or operation.
  • Warranty terms may vary by model and will be communicated individually.

9. Liability

  • Apex Motion assumes no liability for accidents, injuries, or damages resulting from misuse, racing, competition use, modifications, or lack of maintenance.
  • Karts must not be used on public roads.
  • Liability for indirect or consequential damages is excluded to the extent permitted by law.

10. Intellectual Property

All images, designs, and branding used on our website are property of Apex Motion or our partners and may not be reproduced without permission.

11. Governing Law & Jurisdiction

These Terms are governed by Swiss law.

Place of jurisdiction is Schwyz, Switzerland, unless mandatory consumer protection law states otherwise.
